Emergency meteorological events in the municipality of Bardonecchia in the metropolitan city of Turin: initiatives to support customers
Banca Progetto is alongside its customers to overcome the emergency following the exceptional meteorological events that occurred on 13 August 2023 in the territory of the municipality of Bardonecchia in the metropolitan city of Turin, activating the legally mandated measures.
Banca Progetto has implemented the measures outlined in the Order of the Head of the Department of Civil Protection (OCDPC) dated November 9, 2023, No. 1,038, published on the Civil Protection Department's website (Ocdpc n. 1.038 del 9 novembre 2023 | Dipartimento della Protezione Civile) published in the Official Gazette no. 269 of November 17, 2023, regarding the suspension of payment of mortgage installments following the declaration of the state of emergency (resolved on 13 August 2023).
In particular, Article 9 ("Suspension of Mortgages"), paragraph 1, of the Order has provided that the aforementioned event constitutes force majeure as defined and for the effects of Article 1218 of the Civil Code.
With Resolution of the Council of Ministers dated October 15, 2024 – published on the website of the Department of Civil Protection and currently being published in the Official Gazette, it is extended for a further 12 months.
In this regard, individuals holding mortgages related to evacuated buildings or engaged in commercial and economic activities, including agriculture, in the same buildings, may, upon presentation of a self-certification of the damage suffered, request from credit and banking institutions, until the habitability or usability of the said property and in any case not later than the cessation date of the state of emergency (August 13, 2025), a suspension of the mortgage payments, choosing between:
the suspension of the entire installment
the suspension of the capital portion only
Customers can request the suspension of payment from the Bank by submitting the relevant request (see Attachment 1), accompanied by a self-certification made in accordance with Presidential Decree of December 28, 2000, No. 445, and subsequent amendments (see Self-Certification Attachment).
The total suspended amount must be repaid to the Bank without any additional charges or fees in terms of commissions or processing fees. The maturity of the mortgage will be extended for a period corresponding to the duration of the suspension.
In the case of the suspension of the capital portion only, the borrower will pay the Bank, for the duration of the suspension months, an interest installment calculated on the remaining debt on a capital basis, at the rate and in the manner provided in the contract.
In the case of the suspension of the entire installment (capital portion + interest portion), the accrued and potentially suspended interest during the period, unproductive of additional interest, will be divided into equal installments on the subsequent due dates and will be fully payable in the event of mortgage extinguishment or substitut
